1. Acceptance of These Terms

By using this website you agree to these Terms of Service. If you do not agree with them, please do not use the site. If you are using the site on behalf of an organisation, you confirm you are authorised to accept these terms on its behalf.

2. Who We Are

This website is operated by Iron Pint Games ("Iron Pint Games", "we", "us", "our"), an independent game studio. You can reach us at contact@ironpintgames.com.

3. Use of This Website

You may browse this website, and download the materials we have made available for that purpose, for lawful personal, editorial and promotional use. You agree not to:

• Use the site in a way that breaks any applicable law or regulation;
• Attempt to gain unauthorised access to the site, its server, or any connected system;
• Interfere with the site's normal operation, including by introducing malware or by placing an unreasonable load on it;
• Scrape, mirror or republish the site wholesale, or frame it in a way that misrepresents its origin;
• Use the site to send unsolicited commercial messages to us or to anyone else.

4. Intellectual Property

All content on this website — including the Iron Pint Games name and logos, the SWARMED name and logos, artwork, screenshots, trailers, text, layout and code — is owned by Iron Pint Games or used with permission, and is protected by copyright and trade mark law.

Except as expressly permitted in these terms or on our press kit page, you may not copy, reproduce, modify, distribute, or create derivative works from our content without our written permission.

5. Press and Creator Assets

We want people to cover our games. The assets and descriptive copy published on our press kit page may be used in articles, reviews, videos, streams and social posts about our games, including monetized ones, subject to the usage terms set out on that page.

You may monetize video and stream content featuring our games. You may not resell our assets, redistribute them as part of an asset pack, redraw or distort our logos, or use our brand in a way that implies we sponsor or endorse your product, service or channel.

6. Feedback and Submissions

If you send us feedback, bug reports, feature suggestions or other ideas, you agree that we may use them to improve our games and services without any obligation to you, and without payment, credit or confidentiality. Please do not send us confidential information or anything you are not free to share.

7. Buying and Playing Our Games

Our games are sold and distributed through third-party storefronts, currently Steam. When you buy or play a game through such a storefront:

• Your purchase is a transaction with that storefront, governed by its own terms of service and refund policy;
• Any additional end user licence agreement supplied with the game applies to your use of that game;
• Your licence to the game is personal, non-exclusive and non-transferable, and does not transfer ownership of the game or its content to you;
• You may not reverse engineer, decompile, redistribute, resell, or create and distribute cheats, unauthorised modifications or pirated copies of the game, except where such a restriction is prohibited by law.

Refund requests should be made through the storefront you purchased from, under its refund policy.

8. Third-Party Links and Services

This website links to third-party sites and services, such as Steam and video platforms. We do not control them and are not responsible for their content, terms or privacy practices. Following those links is at your own discretion.

9. Availability and Accuracy

We aim to keep this website available and its information current, but we do not guarantee uninterrupted availability. Information about games in development — including features, content and release timing — describes our current plans and may change before release.

10. Disclaimer of Warranties

This website and its content are provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law. Nothing in these terms excludes or limits any statutory rights you have as a consumer that cannot lawfully be excluded.

11. Limitation of Liability

To the fullest extent permitted by law, Iron Pint Games will not be liable for any indirect, incidental, special or consequential loss, or for loss of profits, data or goodwill, arising out of your use of this website.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under applicable law.

12. Suspension and Termination

We may suspend or restrict access to this website, in whole or in part, at any time, including where we reasonably believe these terms have been breached.

13. Changes to These Terms

We may update these terms from time to time. The "last updated" date at the top of this page always reflects the current version, and continued use of the site after a change means you accept the updated terms.

14. Governing Law

These terms, and any dispute arising out of them, are governed by the laws of the jurisdiction in which Iron Pint Games is established, without regard to its conflict of law provisions. The courts of that jurisdiction will have exclusive jurisdiction, except where applicable consumer law gives you the right to bring proceedings in your country of residence.
